Terms & Conditions
These Terms govern your use of YSG Transport passenger travel, parcel delivery, cargo, logistics, and related transport services.
1. Introduction
These Terms & Conditions govern your access to and use of YSG Transport services including passenger travel, parcel delivery, freight, logistics, and digital customer platforms. By using our services, you agree to be bound by these Terms.
2. Definitions
- Company / We / Us means YSG Motors Limited trading as YSG Transport.
- Customer / You means any person or organisation using our services.
- Services means passenger transport, parcel delivery, cargo handling, freight, and logistics operations.
- Parcel / Cargo means items accepted for transportation subject to operational and legal restrictions.
3. Passenger Travel
- Passengers must possess a valid ticket or booking confirmation before boarding.
- Passengers must provide accurate booking and identification information where required.
- Passengers must comply with all safety instructions and reasonable directions from YSG staff, drivers, and authorised personnel.
- We may refuse boarding or terminate a journey where behaviour is unsafe, abusive, illegal, threatening, or materially disruptive.
- Passengers are responsible for arriving at the designated departure point sufficiently early for check-in, boarding, and departure requirements.
- YSG may use reasonable discretion to change vehicles, drivers, routes, departure arrangements, or operational procedures where necessary for safety, security, traffic, vehicle availability, or other operational reasons.
4. Passenger Conduct & Safety
Passengers must conduct themselves respectfully and safely throughout the journey. The following are prohibited:
- Violence, threats, harassment, intimidation, or abuse of passengers, drivers, staff, or partners.
- Damage to vehicles, equipment, facilities, or another person's property.
- Smoking or vaping where prohibited by law, vehicle policy, or staff instruction.
- Carrying or using illegal drugs, weapons, explosives, or other prohibited items.
- Dangerous, reckless, or disruptive conduct that may endanger people or property.
- Failure to follow reasonable safety instructions.
Where reasonably necessary to protect safety, security, property, or the orderly operation of a service, YSG may refuse boarding, stop a journey, or require a passenger to leave a vehicle.
5. Tickets, Bookings & Reservations
- A booking is subject to availability and is confirmed only when YSG or its authorised platform confirms the booking.
- Customers must provide accurate names, contact details, travel information, and other requested information.
- Tickets and bookings may not be transferred to another person unless YSG expressly permits the transfer.
- Passengers must present the required ticket, booking confirmation, identification, or verification information when requested.
- Booking changes, including changes to travel date, passenger details, route, or service, may be subject to availability and applicable charges.
- Missing a scheduled departure may be treated as a no-show and may affect eligibility for a refund or rebooking.
6. Baggage & Personal Belongings
- Passengers are responsible for complying with any baggage allowance, size, weight, and packaging requirements communicated for the applicable service.
- Excess, oversized, or additional baggage may be accepted only where space and operational conditions permit and may attract additional charges.
- Passengers should keep valuables, cash, identity documents, electronic devices, and other important personal items secure and with them where reasonably possible.
- YSG is not responsible for loss or damage caused by a passenger's failure to secure personal belongings, subject always to applicable law.
- Lost property should be reported to YSG as soon as reasonably possible with sufficient details to identify the item and journey.
- Prohibited or dangerous items must not be carried in passenger baggage.
7. Parcel & Cargo Services
- Customers must provide accurate sender, receiver, address, parcel description, quantity, weight, dimensions, declared value, and contact information.
- Customers are responsible for adequate packaging suitable for road transportation and the nature of the goods.
- YSG may inspect shipments for safety, security, fraud prevention, or regulatory compliance.
- YSG may refuse, delay, hold, return, or cancel a shipment where information is incomplete or inaccurate, the shipment is improperly packaged, or the shipment presents a safety, security, operational, or legal concern.
- Additional costs caused by incorrect information, inadequate packaging, failed delivery, storage, re-routing, or other customer-related circumstances may be charged to the customer where applicable.
8. Prohibited & Restricted Items
Customers must not submit or attempt to transport any item that is illegal, unsafe, restricted without the required approval, or otherwise prohibited by applicable law or YSG operational policy.
Where a shipment is suspected to contain prohibited or unlawful items, YSG may refuse, isolate, delay, return, or otherwise handle the shipment as reasonably required and may notify the appropriate authorities where required or permitted by law.
9. Shipment Declarations, Packaging & Inspection
- The sender declares that the information supplied about the shipment and its contents is accurate, complete, and not misleading.
- The sender must not conceal, mislabel, undervalue, or misrepresent the contents, weight, dimensions, quantity, or nature of a shipment.
- The sender is responsible for packaging goods so that they can reasonably withstand ordinary handling and road transportation.
- YSG may request additional information or documentation before accepting or completing a shipment.
- Where inspection is reasonably required for safety, security, fraud prevention, or legal compliance, the customer agrees to cooperate with the inspection process.
- The customer may be responsible for reasonable costs, losses, penalties, or operational expenses resulting from inaccurate declarations, prohibited contents, or inadequate packaging, to the extent permitted by law.
10. Pickup & Delivery
- Delivery timelines are estimates only and may be affected by traffic, weather, road conditions, security issues, operational constraints, or force majeure events.
- Receivers may be required to present identification, verification codes, or signatures upon delivery.
- Customers must ensure that delivery details are accurate and that the receiver is reasonably available to receive the shipment.
- Failed delivery attempts caused by incorrect details, receiver unavailability, restricted access, or other customer-related circumstances may attract additional charges.
- Where a shipment cannot be delivered, YSG may contact the sender or receiver to arrange a reasonable next step, including re-delivery, collection, return, or storage where available.
- Delivery may be considered completed when the shipment is handed to the designated receiver or an authorised recipient and the applicable delivery confirmation is recorded.
11. Pricing, Payments & Charges
- All prices are charged in Nigerian Naira (₦) unless otherwise stated.
- Charges may vary depending on route, delivery mode, weight, dimensions, urgency, passenger requirements, and operational factors.
- Payment may be required before service execution, dispatch, pickup, boarding, or delivery.
- Customers are responsible for all applicable charges associated with the services requested.
- Payments processed through third-party providers may also be subject to their terms, processing arrangements, and applicable charges.
- Where a payment fails, is reversed, is disputed, or is otherwise not successfully received, YSG may suspend or withhold the relevant service until payment is resolved.
- Fraudulent, abusive, or unauthorised payment activity may be investigated and, where appropriate, referred to the relevant payment provider or authorities.
12. Cancellations, Changes & Refunds
- Cancellations may be accepted only in accordance with the applicable booking or service conditions and, where relevant, before dispatch, pickup, or journey commencement.
- Changes to bookings may be subject to availability and applicable charges.
- Refund eligibility may depend on the time of cancellation, service type, operational status, and applicable third-party processing arrangements.
- Refunds may be subject to reasonable administrative fees, operational deductions, or third-party processing costs where permitted.
- Approved refunds may require identity or payment verification before processing.
- Where a customer fails to attend a scheduled journey or fails to make a shipment available at the agreed time, the booking may be treated as a no-show or failed collection, subject to the applicable service terms.
13. Service Delays & Force Majeure
YSG will make reasonable efforts to provide services as scheduled but is not responsible for delays, interruptions, cancellations, or failures caused by circumstances beyond its reasonable control.
- Severe weather, flooding, natural disasters, or other environmental events.
- Traffic congestion, road closures, accidents, vehicle breakdowns, or infrastructure failures.
- Security incidents, civil unrest, public disorder, or other security circumstances.
- Government restrictions, regulatory requirements, public emergencies, or changes in law.
- Strikes, labour disruptions, telecommunications failures, power failures, or third-party service interruptions.
- Any other event reasonably beyond YSG's control.
Where such circumstances occur, YSG may reasonably modify, suspend, postpone, reroute, or cancel affected services. Any refund or alternative arrangement will be handled in accordance with the applicable service conditions and applicable law.
14. Liability, Claims & Insurance
- Subject to applicable law, YSG's liability is limited to direct losses proven to have resulted from YSG's acts or omissions while the relevant service or shipment was under YSG's responsibility.
- YSG is not responsible for losses caused by inaccurate customer information, inadequate packaging, prohibited goods, customer negligence, receiver conduct, or circumstances outside YSG's reasonable control.
- Subject to applicable law, YSG is not liable for indirect, incidental, special, or consequential losses, including loss of profit, business opportunity, or anticipated savings.
- Declared parcel value does not constitute insurance unless YSG expressly confirms insurance coverage in writing.
- Customers who require additional protection for high-value or sensitive goods should arrange appropriate insurance or obtain written confirmation of any additional coverage before shipment.
- Claims should be reported promptly and must include relevant booking, tracking, delivery, payment, or other supporting evidence where available.
Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.
15. Privacy & Data Protection
We process customer information in accordance with applicable Nigerian data protection laws and our Privacy Policy. By using our services, you acknowledge that you have reviewed and understood our Privacy Policy.
16. Website, App & Customer Accounts
- Customers must provide accurate information when creating or using an account.
- Customers are responsible for keeping account credentials and access information reasonably secure.
- Customers must not use another person's account without authorisation.
- Customers must not use our website, application, systems, or services for unlawful, fraudulent, abusive, or disruptive purposes.
- We may temporarily suspend access where reasonably necessary for security, maintenance, investigation, or service protection.
- Website or application availability may be affected by maintenance, technical failures, connectivity issues, or circumstances outside our reasonable control.
17. Account Suspension & Termination
YSG may suspend, restrict, or terminate access to an account or service where reasonably necessary because of fraud, payment abuse, false information, prohibited activity, repeated breaches of these Terms, abuse of staff or partners, unlawful conduct, or other conduct that creates a material risk to YSG, its customers, or its operations.
Customers may request account deletion in accordance with the account-deletion process provided in our Privacy Policy. Termination of an account does not remove obligations or liabilities that arose before termination.
18. Intellectual Property
Unless otherwise stated, YSG Transport and its licensors retain all rights in the YSG Transport name, logo, branding, website, application, software, text, graphics, designs, and other proprietary content. Customers may not copy, modify, reproduce, distribute, publish, or commercially exploit such materials without prior written permission, except where permitted by applicable law.
19. Complaints & Dispute Resolution
Customers are encouraged to contact YSG promptly if they have a complaint about a booking, journey, delivery, payment, staff interaction, or other service issue.
- Complaints should include the customer's name, contact information, booking or tracking reference where applicable, and a clear description of the issue.
- Supporting documents, photographs, receipts, or other evidence should be provided where available.
- YSG will review complaints in good faith and may request additional information where necessary.
- The parties should make reasonable efforts to resolve disputes amicably before commencing court proceedings, subject to applicable law.
20. Service Availability
Service availability may vary depending on route, operational conditions, regulations, public holidays, infrastructure, vehicle availability, staffing, technology, and security circumstances. Publication of a route or service does not guarantee availability at all times.
21. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. The parties should first make reasonable efforts to resolve disputes amicably. Where a dispute cannot be resolved, it may be referred to a court of competent jurisdiction in Nigeria, subject to applicable law.
22. Updates to Terms
We may revise or update these Terms periodically to reflect changes in our services, operations, technology, legal requirements, or business practices. Updated versions become effective when published through our website, application, or other official platform, unless a different effective date is stated.
23. General Provisions
- Entire Agreement: These Terms, together with any applicable service-specific terms and our Privacy Policy, form the principal agreement governing your use of YSG services.
- No Waiver: Failure to enforce a provision of these Terms does not constitute a waiver of the right to enforce it later.
- Assignment: Customers may not transfer their rights or obligations under these Terms without YSG's prior written consent, except where permitted by law.
- Severability: If any part of these Terms is held unenforceable, the remaining provisions shall continue to apply to the fullest extent permitted by law.
- Survival: Provisions that by their nature should continue after termination, including payment obligations, liability, intellectual property, dispute resolution, and applicable legal rights, will continue to apply.
